Introduction
1. Welcome to Maldives Wellness Review (the “Website”, “we”, “us”), owned and operated by Soft Atoll, a sole proprietorship, registered in the Republic of Maldives (Registration No: SP14122023). By accessing our Website, purchasing a subscription, or using our services, you agree to be bound by these Terms and Conditions (“Terms”).
2. These terms supplement and should be read in conjunction with the Privacy Policy at https://www.maldiveswellnessreview.net/ which also applies to your subscriptions and other paid services made available by us.

Subscription Services
1. Digital Access: We offer paid subscriptions that grant access to premium articles, travel guides, and exclusive content (“Premium Content”).
2. Subscription Plans: We offer Monthly/Annual subscription plans. Prices are listed in Maldivian Rufiyaa (MVR) and/or United States Dollars (USD) and are inclusive of Goods and Services Tax (GST) unless stated otherwise.
3. License: Upon payment, you are granted a limited, non-exclusive, non-transferable license to access and view the Premium Content for personal, non-commercial use only. Users are not granted any rights or licenses to download or otherwise permanently store content from the Website, except as expressly permitted by these Terms.
4. Reservation of Rights: Maldives Wellness Review reserves all rights not expressly granted in these Terms.
5. Age: You must be 18 years or older to subscribe and to enter into a binding contract for the subscription services.
6. Account Details: By registering as a subscriber, you agree that you have given us accurate registration details, including payment information and personal details (including age) and will ensure that we always have up to date contact information. You acknowledge that you are responsible for keeping your account and password secure. You agree to accept responsibility for all activities that occur under your account. Maldives Wellness Review reserves the right to deny or cancel orders, and may, in its sole discretion, terminate or suspend accounts.
7. Free Trial: The Website may provide readers with the option to enrol in a trial offer of the subscription. Such offer is governed by the Terms and any other terms presented to you when you sign up for the offer. The trial offer may convert to a paid subscription if you do not cancel before the free trial ends. In such circumstances, we may ask you to provide an applicable billing payment method to register for the trial offer. You agree that the Website may obtain a pre-authorization for the full subscription price that you will be automatically charged if you complete the trial and continue the subscription. In case some financial institutions perceive these requested amounts as actual pending charges, which are not, and you agree that the Website will not be responsible for any results, such as an overdraft fee or other such charges, that may occur to your account with a financial institution as a result of such authorizations. At the end of your stated trial period, your subscription will automatically continue on a rolling monthly or annual basis at the standard rate notified to you at the time of purchase.
8. Prevention of Unauthorized Use: Maldives Wellness Review reserves the right to exercise whatever lawful means it deems necessary to prevent unauthorized or prohibited uses of the Website.

Payment & Billing
1. Payment Gateway: All online payments are processed securely through the Bank of Maldives (BML) Payment Gateway (the “Processor”).
2. Card Data: The Website does not store or process your full credit/debit card details. You will be redirected to the secure BML payment page to complete your transaction.
3. Currency: Transactions will be processed in the currency selected at checkout (MVR or USD). International cardholders may be subject to currency conversion fees charged by their issuing bank.
4. Recurring Billing: By subscribing, you agree to pay for and authorise us to charge your payment method for the cost of subscription and to continue your subscription until cancelled and, on a recurring monthly or annual basis, to charge the payment method you provided the then-current monthly or annual cost of your subscription if you do not cancel within the relevant cancellation period. By choosing a recurrent payment plan, you acknowledge that such services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.
5. Payment Terms: Additional terms may be applicable as determined by agreements between you and the financial institution, credit card or debit card issuer or other provider of your chosen payment method. Moreover, the processing of payments will be subject to the terms, conditions and privacy policies of the Processor in addition to these Terms. We are not responsible for any error by the Processor. By choosing to subscribe, you authorize us, through the Processor, to charge your chosen payment provider. We reserve the right to correct any errors or mistakes that the Processor makes even if it has already requested or received payment.
6. Price Change: We reserve the right to change your subscription price and/or benefits with at least 30 days’ notice. You may terminate your subscription within this notice period.
7. Payment Default: If you default on any payment, or if your payment method is declined, we may suspend your subscription and contact you to arrange payment of outstanding amounts. If you wish to subscribe again, we have the right to require payment in full of any outstanding amount owed to us.

Third-Party Sites, Products and Services; Links
1. The Website may include links or references to other websites or services affiliated with Maldives Wellness Review (“Reference Sites”). Unless otherwise expressly stated by us, Maldives Wellness Review does not endorse any such Reference Sites or the information, materials, products, or services contained on or accessible through Reference Sites.
2. Your correspondence or business dealings with, or participation in promotions of advertisers found on or through the Website are solely between You and such advertisers. Access and use of Reference Sites, including the information, materials, products, and services on or available through Reference Sites is solely at Your own risk.

Termination, Cancellation, & Refund Policy
1. Termination: We may, at any time and at our sole discretion, terminate your subscription with us where we believe that we have grounds to terminate (for example, for non-payment or breach of these Terms or other such terms). In the event that we terminate your account due to an actual or suspected breach of terms, services purchased in accordance with these Terms may be forfeited without any refund.
2. Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the end of the then-current billing period.
3. No Refunds on Digital Goods: Due to the immediate nature of digital content access, all fees paid are non-refundable. We do not offer prorated refunds for partially used subscription periods, except where required by Maldivian law.
4. Effect of Cancellation or Termination: Upon any cancellation or termination, the rights and licenses granted to You under these Terms and any additional terms and conditions will automatically terminate and the following provisions will survive: “Effect of Cancellation or Termination,” “Proprietary Rights,” “Indemnification,” “Disclaimers; No Warranties,” “Limitation of Liability and Damages,” “Disputes,” and “Miscellaneous.”
5. Processor Errors: If a transaction fails or is duplicated due to a BML system error, please contact us immediately at marketing@softatoll.com with your Transaction ID. We will coordinate with BML to rectify valid billing errors.

Amendment

Proprietary Rights
1. The visual interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, services, functions and all other elements of the Website provided by Maldives Wellness Review (the “Materials”) are protected by applicable copyright and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws.
2. All Materials contained on Maldives Wellness Review are the property of Maldives Wellness Review or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to Maldives Wellness Review or its affiliates and/or third-party licensors.
3. Except as expressly authorized by Maldives Wellness Review, You agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Materials or services. The domain name on which the Website is hosted is the sole property of Maldives Wellness Review and You may not use or otherwise adopt a similar name for Your own use.
4. You may not reproduce, distribute, modify, or share login credentials to access Premium Content. Systematically scraping or “crawling” our content is strictly prohibited.

User Conduct
1. Share your account credentials with others to bypass the paywall.
2. Post unlawful, defamatory, or offensive comments on articles.
3. Attempt to breach the security of the Website or the BML Payment Gateway.
4. Rent, lease, loan, sell, resell, sublicense, distribute, display or otherwise transfer the licenses granted herein or any Materials (as defined in Section 7 above).
5. Impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the Accounts of others without permission, forge another persons’ digital signature, misrepresent the source, identity, or content of information transmitted via Maldives Wellness Review, or perform any other similar fraudulent activity.
6. Delete the copyright or other proprietary rights notices on Maldives Wellness Review or associated with any Materials available via Maldives Wellness Review.
7. Make unsolicited offers, advertisements, proposals, or send junk mail or spam to other Users of Maldives Wellness Review. This includes, but is not limited to, unsolicited advertising, promotional materials, or other solicitation materials, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures.
8. Use Maldives Wellness Review for any illegal purpose, or in violation of any national or international law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy.
9. Defame, harass, abuse, threaten or defraud Users of Maldives Wellness Review, or collect, or attempt to collect, personal information about Users or third parties without their consent.
10. Remove, circumvent, disable, damage or otherwise interfere with rights enforcement and other security-related features that prevent or restrict use or copying, printing, storing, transferring, or sharing of any Content accessible through Maldives Wellness Review, or features that enforce limitations on the use of Maldives Wellness Review or any Materials available via Maldives Wellness Review.
11. Reverse engineer, decompile, disassemble or otherwise attempt to discover Maldives Wellness Review source code or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
12. Modify, adapt, translate or create derivative works based upon Maldives Wellness Review or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
13. Intentionally interfere with or damage the operation of Maldives Wellness Review or any User’s enjoyment of any part thereof, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.
14. Use any robot, spider, scraper, or other automated means to access Maldives Wellness Review, or copy, print, access, store, transfer, or share any Materials accessible through Maldives Wellness Review, for any purpose or to bypass any measures Maldives Wellness Review may use to prevent or restrict access, or the ability to copy, print, access, store, transfer, or share Materials.
15. Reproduce, display or otherwise provide access to the Website and/or the Website Functions, Material or any third party content (“Third Party Content”) on another app, website or server, for example through linking, framing, mirroring or any other technological means whether available now or in the future unless the prior written consent of Maldives Wellness Review is obtained.
16. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through Maldives Wellness Review.
17. Interfere with or disrupt servers or networks related to the operation Maldives Wellness Review, or disobey any requirements, procedures, policies or regulations of networks connected to Maldives Wellness Review.
18. Post, upload or distribute marketing material, advertisements, spam, content designed to aid search engine optimization, or other content that in Maldives Wellness Review’s sole opinion detracts from the Maldives Wellness Review experience.
19. Use any portion of the Content on Maldives Wellness Review for the purposes of training a large language model.
20. Download or print more than one copy of the information available on the Website for your personal, internal and non-commercial use only, provided you have kept all copyright and other proprietary notices intact. Permission to reprint or electronically reproduce any part of the Website, its Functions, Material or Third Party Content whether in whole or in part for any other purpose is expressly prohibited without Maldives Wellness Review’s prior written consent, and the written consent of the owners of Third Party Content.
21. Submit any content that is illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable.
22. Submit any content or statement that is contrary to public interest, public morality, public order, public security, national harmony, or otherwise be prohibited by applicable laws and regulations.

Indemnification
Disclaimers; No Warranties.
1. To the fullest extent permissible pursuant to applicable law, Maldives Wellness Review, and its affiliates, partners, and suppliers disclaim all warranties, statutory, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by You from Maldives Wellness Review or through our services will create any warranty not expressly stated herein. You expressly acknowledge that the term Maldives Wellness Review includes Maldives Wellness Review’s officers, directors, employees, shareholders, agents, licensors and subcontractors.
2. You hereby acknowledge and agree that the Website may use transmissions over the Internet which are never completely private or secure and that any information transmitted to the Website may not be confidential and You have no expectation of privacy with respect to such information, subject always to the Website’s Privacy Policy.
3. You also agree that Maldives Wellness Review shall be entitled at any time, at its sole and absolute discretion and without prior notice, to add to, vary, terminate, withdraw or suspend the operation of the whole or any part or feature of the Website or Content without assigning any reason.
4. You further agree that access to or the operation of the Website may from time to time be interrupted or encounter technical or other problems and may not necessarily continue uninterrupted or without technical or other errors.
5. In any such event, Maldives Wellness Review shall not be liable for any loss, liability or damage which may be incurred as a result.
6. We give no warranties of any kind in relation to or in connection with any third party platform, third party app, or other third party provided functions contained in or performed or enabled by or through the Website, and each in case, for third party provided functions contained in or performed or enabled by or through the Website, these are provided under separate terms and conditions of third parties, and we are not responsible for the functionality, performance or any incidences arising from or in connection with such platforms.

Limitation of Liability and Damages
1. Under no circumstances, including, but not limited to, negligence, will Maldives Wellness Review or its affiliates, contractors, employees, agents, or third-party partners, licensors, or suppliers be liable for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation damages arising from any unsuccessful court action or legal dispute, lost business, lost revenues or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) arising out of or relating to these terms or that result from your use or your inability to use the materials on Maldives Wellness Review or any Reference Sites, or any other interactions with Maldives Wellness Review, even if Maldives Wellness Review or a Maldives Wellness Review authorized representative has been advised of the possibility of such damages.
2. We do not guarantee that the Website will be uninterrupted or error-free. We are not liable for transaction failures caused by banking networks or the BML gateway downtime.
3. In no event will the total liability of Maldives Wellness Review or its affiliates, contractors, employees, agents, or third-party partners, licensors, or suppliers to you for all damages, losses, and causes of action arising out of or relating to these terms, Your use of Maldives Wellness Review or your interaction with other Maldives Wellness Review users (whether in contract, tort including negligence, warranty, or otherwise), exceed the amount paid by You, if any, for accessing Maldives Wellness Review during the three (3) months immediately preceding the date of the claim.
4. You acknowledge and agree that Maldives Wellness Review has offered its services, set its prices, and entered into these terms in reliance upon the warranty disclaimers and limitations of liability set forth herein, that the warranty disclaimers and limitations of liability set forth herein reflect a reasonable and fair allocation of risk between You and Maldives Wellness Review, and that the warranty disclaimers and limitations of liability set forth herein form an essential basis of the bargain between You and Maldives Wellness Review. Maldives Wellness Review would not be able to provide services to you on an economically reasonable basis without these limitations.

1. Notice: Maldives Wellness Review may provide You with notices, including those regarding changes to Maldives Wellness Review’s terms and conditions, by email, or postings on the Website. Notice will be deemed given immediately after email is sent, unless Maldives Wellness Review is notified that the email address is invalid. Alternatively, we may give You legal notice by mail to a postal address, if provided by You. In such case, notice will be deemed given 3 (three) calendar days after the date of mailing. Notice posted on the Website is deemed given 1 (one) calendar day following the initial posting.
2. Waiver: The failure of Maldives Wellness Review to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Maldives Wellness Review.
3. Severability: If any provision of these Terms is held to be unlawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from these Terms to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.
4. Assignment: These Terms and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by Maldives Wellness Review without restriction. Any assignment attempted to be made in violation of these Terms shall be void.
5. Survival: Upon termination of these Terms, any provision which, by its nature or express terms should survive, will survive such termination or expiration, including, but not limited to Section 9 to 13.
6. Headings: The heading references herein are for convenience purposes only, do not constitute a part of these Terms, and will not be deemed to limit or affect any of the provisions hereof.
7. Entire Agreement: These Terms are the entire agreement between You and Maldives Wellness Review relating to the subject matter herein and will not be modified except in writing agreed to by both parties, or by a change to these Terms made by Maldives Wellness Review as set forth in Section 6 above.
8. Claims: You and Maldives Wellness Review agree that any cause of action arising out of or related to Maldives Wellness Review must commence within six (6) months after the cause of action accrues. Otherwise, such cause of action is permanently barred.
